On 13 June 2024 the US District Court for the Northern District of Texas vacated it outright in Mock v. Garland (case 4:23-cv-00095), holding that it violated the Administrative Procedure Act. The government appealed and then abandoned the appeal: the parties filed a stipulation of dismissal on 17 July 2025 and the Fifth Circuit dismissed it on 24 July 2025. The case is now styled Mock v. Bondi. Nothing is pending, and there is no rule left to comply with.
So a brace on your Draco is a brace. No registration, no Form 1, no $200 stamp, no engraving.
What did not change is the part that puts people in prison. The National Firearms Act definition of a short-barreled rifle was never touched by any of this litigation. Fit an actual stock to a Draco and you have built an SBR: a shoulder-fired firearm with a barrel under 16 inches. That is a Form 1, a $200 tax stamp and ATF approval before you put the parts together, not after. A dead brace rule is not permission to shoulder a stock, and the two things get confused constantly in AK forums.
