Governor Patrick Morrisey took office in January 2025 and has continued the firearm-friendly posture established by Governors Justice and Tomblin before him.

Our Take on West Virginia Gun Laws
For practical everyday purposes, West Virginia gun laws are firmly in the permissive tier. Constitutional carry, no waiting period, no magazine cap, no AWB, no red flag law, codified Stand Your Ground at ยง 55-7-22, and broad reciprocity make WV one of the easier jurisdictions for a serious carrier or hunter.
The CHL remains worth getting for reciprocity travel and the Provisional CHL is meaningful for 18-21 year olds who want concealed carry authority during the gap between adulthood and the constitutional-carry age. Frequently Asked Questions: West Virginia Gun Laws
Is West Virginia a constitutional carry state?
Yes. West Virginia enacted constitutional carry of handguns under SB 347, which took effect May 24, 2016 after the legislature overrode Governor Tomblin's veto. Adults 21 and older who can lawfully possess a handgun may carry concealed or openly without a permit. The 18-21 age group can use the Provisional Concealed Handgun License under W. Va. Code ยง 61-7-4a.
Why get a West Virginia Concealed Handgun License if it's optional?
Reciprocity. The West Virginia CHL under W. Va. Code ยง 61-7-4 is honored in 38+ other states under formal reciprocity. The 4-hour state-approved firearms training course is reasonable, the $75 initial fee is moderate, and the five-year validity makes the CHL a useful travel document. Constitutional carry covers you inside West Virginia, but the CHL travels.
Is open carry legal in West Virginia?
Yes. Open carry of handguns and long guns is legal for adults 18+ without a permit. Vehicle carry is also permitted without restriction beyond the standard sensitive-location prohibitions.
Does West Virginia have universal background checks?
No. West Virginia requires NICS background checks at federally licensed dealers (FFLs) but does NOT require background checks on private sales between West Virginia residents. There is no purchase permit requirement and no waiting period.
What is the West Virginia Provisional CHL?
The Provisional Concealed Handgun License under W. Va. Code ยง 61-7-4a covers ages 18 to 21. Same 4-hour training course and $75 fee as the standard CHL. The Provisional CHL expires when the holder turns 21 and converts to a standard CHL. The Provisional pathway exists because constitutional carry requires age 21+, so the Provisional CHL is the only state-issued mechanism for concealed handgun carry by 18-21 year olds.
Does West Virginia honor out-of-state concealed carry permits?
Yes. West Virginia honors valid concealed carry permits from all 50 states for non-residents 21+ under broad reciprocity. Adults 21+ from constitutional-carry states can also carry in WV without a permit since the state permits the same. The WV CHL is honored in 38+ other states.
Does West Virginia have Stand Your Ground and Castle Doctrine?
Yes for both, codified at W. Va. Code ยง 55-7-22 by the 2008 act. No duty to retreat anywhere a person has a legal right to be when reasonably defending against death or great bodily injury. Castle Doctrine applies in dwelling, business, and occupied vehicle. The statute provides civil-suit protection through the same framework.
What sensitive locations are off-limits in West Virginia?
K-12 schools (W. Va. Code ยง 61-7-11a), courthouses, federal facilities (18 U.S.C. ยง 930), the West Virginia State Capitol (with separate security protocols), and posted private property. Most public colleges and universities prohibit firearms by institutional policy. State preemption at ยง 8-12-5a prevents municipalities from adding zones beyond what state and federal law specify.
