What the Court Did
On June 3, 2026, Lynchburg Circuit Court Judge Patrick Yeatts rejected the state’s attempt to throw out an injunction he had already issued against Virginia’s universal background check law, and the Virginia State Police halted private-sale checks in response.
The underlying order goes back to October, when Judge Yeatts issued a permanent injunction and final order striking Virginia’s 2020 law requiring background checks on sales between non-licensed sellers. That law is what closed the so-called private-sale gap, requiring two private parties to route a transfer through a licensed dealer for a background check.
After that injunction, the General Assembly passed HB1525, a 2026 measure meant to align state law with federal law on under-21 purchases and to nullify the court order. The State Police resumed requiring the checks once that law took effect. Judge Yeatts then rejected the state’s effort to vacate his injunction, which put the halt back in place.
Why the Law Got Struck
Judge Yeatts found Virginia’s background check law unconstitutional as applied to adults under 21, and ruled that the unconstitutional portion could not be cut out, so he struck the entire law.
That severability question is the heart of it. When a court finds part of a statute unconstitutional, it often removes just the bad part and leaves the rest standing. Yeatts concluded the law couldn’t be cleanly separated that way, which meant the whole statute fell rather than just the piece affecting under-21 buyers. That’s why a ruling about a specific age group took down the universal check requirement across the board.
What This Means If You’re Buying or Selling in Virginia
A private firearm sale between two Virginia residents currently requires no background check, while any sale through a licensed dealer still requires the standard federal NICS check.
The change affects private, person-to-person transfers only. If you buy from a dealer, a gun show table run by a licensed dealer, or an online retailer that ships to your local FFL, the federal check still applies and nothing has changed. Federal law also still bars certain buyers regardless of state rules, and it remains a crime to knowingly sell to a prohibited person whether a check happens or not.
One more point worth keeping straight. Federal law still restricts handgun purchases from licensed dealers by buyers under 21, and that hasn’t moved.
